In light of the latest developments in Workplace Health and Safety (WHS), we’re highlighting the key impact these legislation amendments will have on businesses. The Work Health and Safety and Other Legislation Amendment Act 2024 (Qld) has been enacted to implement recommendations from an independent review of Queensland’s WHS Act, with a particular focus on the role of health and safety representatives (HSRs).

Key Impacts of the Amendments

Productivity Concerns: The introduction of additional safety dispute administrative processes, rights, and stop-work notices has raised concerns about potential interpretations and abuse. Managing safety on sites while maintaining productivity requires a balanced approach focused on problem-solving and minimizing delays.

Management of WHS Disputes: HSRs will need additional training to understand their obligations fully. This includes ensuring the productive use of labour to minimize productivity losses, reduce conflict, and prioritize solution-focused approaches. Decisions to stop work must be reasonable and based on immediate risk assessments.

Right of Entry: The capacity of HSRs to invite union officials to assist with safety disputes may have limited impact on large commercial projects. It’s crucial to clarify that unions can provide advice but not instructions. PCBUs (Persons Conducting a Business or Undertaking) may need policies or processes to ensure transparency when union involvement is requested.
